Secretary DeVos Forgoes Waiving Disability Law Amid School Closures

“U.S. Education Secretary Betsy DeVos will not recommend that Congress waive the main requirements of three federal education laws, including the Individuals with Disabilities Education Act, known as IDEA. The federal law ensures that children with disabilities have a right to a free, appropriate public education whenever and wherever schools are operating.”

COVID-19 has not changed your School District’s responsibility to provide a free and appropriate public education. There are limited waivers granted in NY including extended timelines.
However, what this means is that your child’s school cannot:
– Change the IEP without consulting you
– Change the IEP without your express consent
– Skip communicating with you

– not provide IEP services
– Fail to implement accommodations, modifications, and services as outlined in the existing/current IEP
