Proposed Amendments to Section 200.5 of the Regulations of the Commissioner of Education Relating to Special Education Due Process System Procedures

- At their February 2023 meeting, the Board of Regents proposed amendments to section 200.5 to the Regulations of the Commissioner of Education relating to special education due process system procedures in the areas of (1) granting impartial hearing extensions; (2) enforcement of mediation and resolution agreements; (3) increasing use of mediation; (4) establishing rules of conduct; and (5) providing flexibility for conducting hearings in different modes. It is anticipated that the proposed amendments will be presented for permanent adoption at the June 2023 Regents meeting, effective June 28, 2023.
- You are invited to provide comment on and/or participate in public hearings on these proposed regulations relating to special education due process system procedures.
- Comment regarding the proposed action may be submitted to Christopher Suriano, Assistant Commissioner, Office of Special Education, Room 301M, Education Building, 89 Washington Avenue, Albany, NY 12234 (REGCOMMENTS@nysed.gov). Comment must be submitted by May 8, 2023.
- Three public hearings are scheduled:
- May 1, 2023 (11:30 am-1:00 pm), virtual-only
- May 1, 2023 (6:00-7:30 pm), virtual-only
- May 2, 2023 (4:00-5:30 pm), in-person only (Albany, New York)
